Terms and Conditions of Sale

1. Seller and contact details

2. Scope

These terms govern purchases of physical products, including CDs, vinyl records and books, from musicforgestudio.site. Competition entries, tickets, services and digital content are subject to the specific information and terms of the relevant offer. Consumer protection provisions apply to purchasers acting as consumers.

3. Products, prices and availability

The product page states the item’s characteristics, format, price and availability. Images are illustrative; provisional artwork and any edition-specific features are identified on the product page. Prices are in euros. Tax treatment, delivery charges and any other costs are disclosed before the order is submitted. An item without a price or marked as unavailable for purchase is not an active offer for sale.

4. Orders and payment

Guest checkout and account purchases are available when shown at checkout. Before confirming, you can check and correct the products, quantities, addresses and amounts. Submitting an order using the control indicating an obligation to pay means accepting the terms applicable to that purchase. The contract is concluded when MusicForgeStudio confirms acceptance of the order; an automated acknowledgement of receipt alone does not constitute acceptance.

The payment methods actually available are shown at checkout. Payment results and order status are sent to the email address provided. If an item becomes unavailable, we will inform you and refund any amounts received for products we cannot supply. Please retain your order confirmation and the terms supplied.

5. Pre-orders

Pre-order products are expressly identified. The price, payment arrangements and agreed delivery date or period must be available before purchase. An estimated date is distinguished from a guaranteed date. We will inform you of delays, without affecting your statutory rights concerning non-delivery and withdrawal. Announcing a forthcoming vinyl edition does not automatically open pre-orders.

6. Shipping and delivery

Available destinations, delivery costs and applicable times are stated during checkout. Any applicable customs charges for non-EU destinations are disclosed before ordering where relevant. Unless a different deadline is expressly agreed, goods are delivered without undue delay and no later than 30 days after the contract is concluded.

The risk of loss or damage passes to the consumer when the goods are physically received by the consumer, or their nominated third party other than the carrier, subject to statutory exceptions. Please report visible parcel damage promptly. Failing to record a reservation with the carrier does not remove mandatory consumer rights. Statutory remedies for non-delivery remain available.

7. Right of withdrawal

If you purchase as a consumer, you may withdraw without giving a reason within 14 days after receiving the goods. For several items under one order delivered separately, this period starts when the last item is delivered. You may also notify withdrawal before delivery. Send an unequivocal statement to info@musicforgestudio.site or by post to the seller’s address. You may use the model below, but no particular wording is mandatory.

Return the goods within 14 days after notifying withdrawal to MusicForgeStudio by Antonio Lambresa, Via Gino Buttazzi 35, 71027 Orsara di Puglia (FG), Italy. The customer bears the direct cost of returning goods for a change of mind. Notifying withdrawal does not require discretionary approval from the seller. You are liable only for any diminished value resulting from handling beyond what is necessary to establish the goods’ nature, characteristics and functioning.

8. Exception for sealed recordings

For sealed audio or video recordings, the change-of-mind withdrawal right is excluded if the seal has been broken after delivery, as provided by Article 59(i) of the Italian Consumer Code. This exception does not automatically apply to all books or to any opened packaging. Rights concerning lack of conformity remain unaffected.

9. Refunds

Following a valid withdrawal, we refund payments received, including the cost of the least expensive standard delivery option offered, within 14 days after notification. An additional charge for a more expensive delivery method chosen by the customer is not refunded. We may withhold reimbursement until we receive the goods or evidence that they have been sent back, whichever is earlier. We use the original payment method unless you expressly agree otherwise, without refund charges.

10. Legal guarantee and faulty goods

New goods purchased by consumers carry the statutory two-year legal guarantee of conformity from delivery. If you identify a fault, contact us with the order details and a description of the problem. Statutory remedies include repair or replacement free of charge and, where the legal requirements are met, a price reduction or termination of the contract. Necessary costs of a remedy due for lack of conformity are not charged to the consumer as change-of-mind return costs.

12. Complaints, applicable law and personal data

For assistance or complaints, email info@musicforgestudio.site and include the order number. Italian law applies without depriving consumers of mandatory protections under the law of their country of residence where applicable. Jurisdiction is determined by mandatory consumer rules, including the consumer’s local court where required. Applicable alternative dispute resolution procedures remain available.

Personal data processing is described in the Privacy Policy. Future amendments to these terms apply to new orders; each purchase remains governed by the version communicated when the order was placed.
